1. Do you believe Erika violated HIPAA? If so, which section of HIPAA regarding the definition of "health information" would you use to explain to Erika that what she did was wrong? Erika did, in my opinion, violation HIPAA. If I were Erika's boss or coworker, I would go to her and let her know that the HIPAA regulation probably prohibited what she was doing. I would then point out to her that there is a line in the HIPPA book on page 16 that she might want to review. I would continue by explaining that she probably made a mistake in taking a picture of the event because she also probably took a picture of the license plate of the car. The book explains that "Individually identifiable health information is information that is a subset of health information," thus I would continue by saying that the fact that the photo was "created" by a "healthcare provider" would probably qualify as "health information." Considering that she is the one who took the photo and a health provider. I should also point out that the patient's identity may be exposed because the license plate was visible. 2. In our current technological age where everybody has a camera on their phone, whenever there is a medical emergency in public you will see multiple people filming the incident. Although HIPAA does not restrict private individuals, why would be the benefits and disadvantages of doing that? Name and explain one disadvantage and one advantage. Technology has become a huge part of our culture, and it seems like everyone you turn around is clutching some kind of gadget. Technology is present everywhere, from tablets to smartphones to smart watches, thus it's extremely likely that in an emerging During an emergency, someone recorded video or snapped photos. I absolutely think there are two sides to the technology world we live in. particularly with regard to potential civil procedural and liability concerns. One benefit of living in such a modern age is that most of the time, these media offer evidence that may be helpful in understanding or providing a general sense of what probably happened during the incident, as well as shed light on what happened and serve as evidence of who is accountable.
