Topic Findings and Recommendations Regulatory Bodies Broadwater Medical Center will need to comply with the regulations but forth by HIPAA. Information such as demographics including name, date of birth, location, medical history information, and health insurance information is all protected by HIPAA and their privacy and security regulations. This information is known as “Protected Health Information”, and must be protected in compliance with HIPAA standards, which is overseen by the Office of Civil Rights.(U.S. Department of Health & Human Services, 2021) Impact of Data Regulation Due to the ever-growing use of data in everyday lives, regulations must change to keep up with the changing times. HIPAA also constantly updates their regulations to fully protect people’s data. If regulations become more strict, there will need to be changes to how all employees with access to protected health information handles the data. Same goes for if the regulations are ever loosened. This can be anything from more limited access to information for certain parts of the company to new training on how to handle certain data. If regulations were to become more strict, this may effect how patients access their own information. There could potentially be more steps a patient has to take to get their information, which can increase the steps the company must also follow. 2
Topic Findings and Recommendations Currently, there are some changes to the HIPAA regulations that may be implemented soon. Many of the changes have to due with easing a patients access to their protected health information including lowering the time to gain requested PHI from 30 days to 15 and allowing patients to take notes and photos of their PHI in person. (HIPAAjournal.com, 2019) These changes will affect the workload of the company, but will ultimately benefit the patient. Regulating Data Usage When handling both sensitive data and non-sensitive data, there is definitely a benefit of ease when dealing with non-sensitive data. As it is not always protected health information, there is less regulation and rules on how the data is handled, since if the information was mishandled, there is a negative consequence. Oppositely, when handling sensitive data, there is a bigger burden on following rules and regulations by the company. If the company is not in compliance with the regulations of handling the data, then the company may get in trouble and also potentially harm the patient. While it is important to keep the privacy and security of the sensitive data, it does add a burden to the company. Some examples of this sensitive data would be much of a patient’s protected health information including medical history, health insurance information, and personal identifying demographics.
