The impact of this decision was towards the victim and the victim’s family not being satisfied with what that judge offered as a punishment. Even though the prosecution was asking for six years in state prison for this
crime. This is a negative impact because they
were wanting more justice for their child since they were violated and raped.
The law that may have influenced the judge’s
decision was the Penal code stating that Rapes an act of sexual intercourse without the persons consent and one part of that is that a person cannot consent if said person is
unconscious or asleep. It states that the victim of this crime was unconscious when this sexual act occurred.
