What state from the provided resources offers the best privacy protection laws for consumers? Based off the list provided, the State of North Carolina offers the best privacy protection laws for consumers. North Carolina requires all businesses located in the state or businesses with information of North Carolina residents that have experienced a data breach to notify all individuals without unreasonable delay. North Carolina laws define a security breach as the unauthorized release of unencrypted or unredacted records or data containing personal information. North Carolina provides a long list of which they feel if breached consumers should be notified. They cover their residents from any type of breach requiring the companies to provide clear and conspicuous notification. With the requirement to have to provide notice to consumers, it is required that all businesses, state, and local government agencies report security breaches to the Attorney General Consumer Protection Division. How do these privacy protection laws compare to the state you live in? In the state that I live in NJ, has recently added new laws to protect residents. In 2017 Governor Chris Christie signed into law the Personal Information and Privacy Act. This law limits the information that establishments can obtain from an ID card and what the information can be used for ( New Jersey’s Personal Information and Privacy Protection Act Signed into Law , 2017 ) . With the addition of these new laws NJ is among many states that have been consistently updating laws to protect the people in NJ. In addition to these new laws NJ follows like North Carolina requiring notification to any individual whose personal information has been obtained. Data breaches in NJ are to be reported to the State of New Jersey Data Breach Report form. It is
required that when reporting the breach, you must provide details which consist of the number of residents affected, the data compromised and consumer notification. Once reported the NJCCIC sends it to the state police for possible criminal activity and the NJ office of Attorney General for consumer impact. NJ requires data breaches to be reported in a timely, accurate, and transparent manner to impacted business partners, regulators and/or consumers. Organizations issue a public statement with a free comprehensive package of identity theft protection and credit file monitoring (2021). As a consumer, would you change anything about the privacy protection laws in the state you live in? The state of New Jersey is consistently updating laws to protect its consumers. The current laws protect each individual and provide resources if a data breach has occurred. With the constant changes it has become difficult for states like New Jersey to constantly keep up. With the exception of California, whose data privacy legislation became effective on January 2, 2020. Most states including New Jersey have a mix of older privacy laws, newer laws relating to reporting of breaches, and many pending bills (Lambert, 2020) . With new biometric technologies such as facial recognition, biometrics, and blockchain technology which all stores personal data providing new legislation to protect consumers has had its challenges (Lambert, 2020) . I understand the state of NJ is trying to keep up and constantly trying to pass legislation to protect its consumers. I wouldn’t change anything regarding privacy protection laws would just hope the people who pass the legislative laws understand how important it is to protect consumers and pass the new legislation as quickly as possible.
