The early iterations of The Health Insurance Portability and Accountability Act were enacted in 1996 and came into law to combat fraud, protect privacy, transport information from one employer to another, and secure personally identifiable information (PII) (Meingast, et al, 2006). In the case of the student attending the college where his professor found out his students Protected Health Information (PHI), there was a clear violation of privacy, and a complaint is admissible. By 2003, federal regulations and changes made to HIPAA required compliance for PHI which is known as the Privacy Rule. One of the distinct details in this change was that PHI was not shareable without consent granted from the individual. According to the law there must be safeguards, access control, and education on protection for PHI that must be implemented to avoid any violations of privacy (Mercuri, 2004). There is an exception to the rule which outlines there must be some kind of abuse to release PHI without consent to appropriate government agencies and authorities. However, in the case of the professor clearly violating HIPPA, the professor could be held criminally liable for unauthorized access to the student’s records (Bodie, 2022). The student has a quick avenue of approach when it comes to filing a HIPAA complaint. Over the years it has gotten significantly easier to file a complaint. The way it has gotten easier is that I can now be done through mail, fax, e-mail, or online. The different requirements that are needed are the details and circumstances in which the individual believes there were clear violations of privacy or security. The other requirement is that it must be filed within 180 days of the incident. When filing online, the individual must include details about them, the incident, and any other additional information that might assist the review process. In conclusion, HIPAA was enacted in 1996 and has evolved to better protect and defend protected health information from unauthorized access and disclosure (Bodie, 2022). There are criminal penalties for violating HIPAA and the law must be followed or any violations someone will be held liable. In the case of the professor accessing the student’s protected health information, all the student needs to do is file the case online or through any one of the different methods listed in the paper and the case will be reviewed. Important attention on the form is the description of the incident and information about the individual. It is important that HIPAA continues to evolve and adapt to new security measures to prevent unauthorized access and disclosures.
