Section 1 The information that should be gathered during the initial client interview should include basic background information about the client, such as full legal name, age, date of birth, place of residence, place of employment, any prior felony convictions. Following the basic background questions would be building a chronological timeline of the suit. First, starting with specific questions pertaining to the events that brought the client to file the action. Second would be questions gathering details of the event itself. Third, ask what happened after the event, and what were the damages the client sustained emotionally, financially, or physically. Lastly, ask if the client has any additional questions or concerns I may need to relay to the atty. The importance in obtaining this information is to gather as many facts to piece together what occurred, identify the strong and weak points in the case, to get a feel for what kind of client we are representing, and what, if any, other claims we can file suit against. Section 2 1. Jim attended a party Saturday night. 2. Jim is a 17 year old High School student. 3. Jim did not drink at the party, he was focused on Susie. A. Was Jim with Susie the entire time at the party? B. Did Susie witness Jim give his car keys to his friend? C. Did Susie see how long until Jim got his keys back? D. Was Susie drinking at the party? 4. Jim’s friend asked to borrow his car keys to move his car. 5. Jim left the party just after midnight when he was arrested for theft of goods.
Section 3 1. Issues of Fact: Mr Jones was chopping down a tree close to the fence between his yard and Mrs. Smith's yard. A large limb fell into Mrs. Smith’s yard and injured her dog. Is he at fault? a. Investigation Points: Did Mr. Jones notify Mrs. Smith that he was going to chop the tree down? What side of the property line is the tree on? What was the time of day, was it dark out? b. Issues of Law: Was a permit required to chop down the tree? If so, did Mr. Jones have a permit? Is there a leash law that requires Mrs. Smith to have her dog on a leash on her own property? 2. Issues of Fact: Mrs. Brown purchased a lot but the deed of sale was not dated or notarized. Is the deed still binding? a. Investigation Points: Who sold Mrs. Brown the lot? When was the lot purchased? Is the lot fully paid off? b. Issues of Law: Is the deed a valid contract if it was not dated or notarized? 3. Issues of Fact: Mr. Able owns the grocery store and witnessed a patron throw himself off a cart corral. Is Mr. Able liable? a. Investigation Points: Are there any other witnesses? Is there video recording? Did Mr. Able try to intervene or warn the patron prior to the incident? b. Issues of Law: Did the patron assume risk by being on the cart corral? Is there a warning sign to deter people from being on the cart corral? 4. Issues of Fact: Mr. Tinker’s model airplane crashed into a home window after the rudder failed. The homeowner states uncontrolled flight of model airplanes is not allowed at the park. Are model airplanes allowed at the park? a. Investigation Points: What is the definition of “uncontrolled flights?” How close is the home to the park? b. Issues of Law: What model planes are permitted and are not permitted at the park? 5. Issues of Fact: Mrs. Hulah Charges people at the beach, one of her birds bites a boy's face after the parents of the boy placed the bird on his shoulder. Is Mrs. Hulah or are the parents at fault? a. Investigation Points: Has the bird bitten someone before? Did the child's reaction provoke the parrot? b. Issues of Law: Did the parents of the boy assume risk by placing the animal on their child's shoulder? Does Mrs. Hulah hold strict liability over her animals?
