1. What are the elements of the crimes of terrorism, sedition, and treason? The key elements of terrorism are (1) the perpetration of a criminal or threatening act, (2) the intent to spread fear among the population, and (3) the act involves a transnational element. The elements for sedition are two or more people in any state or territory conspire to overthrow, put down, or destroy by force the government or to levy war against them or to oppose by force the authority thereof or by force to prevent, hinder, or delay the execution of any law of the US. The elements of treason are levying war against the US or adhering to their enemies, giving them aid and comfort. 2. Explain the difference between human smuggling and human trafficking. Human smuggling is illegal immigration in which an agent is paid to help a person cross a national border, but human trafficking is the exploitation of unwilling or unwitting people through force, coercion, threat, or deception. 3. Modern terrorism confounds the historic legal distinctions between crimes and war. Do you believe the current war on terrorism should be governed by the rules of criminal law or by the rules of war? Explain and support your response. 4. What are Son of Sam laws? Son of Sam laws are notoriety-for-profit laws that are intended to deny convicted offenders the opportunity to further capitalize on their victims. 5. What is the difference between a victim in fact and a victim at law? Victim at law is the party who has legal standing to prosecute the person who commits a criminal offense, victim in fact is the person who is the subject of a criminal act. 6.
