Mental Health Bill of Rights state individuals have the same entitlement to benefits for mental and drug addiction treatment as they have for any other condition, with the same provisions, co-payments, lifetime benefits, and catastrophic coverage in both insurance and self-funded/self- insured health plans. 2.
Similarities-
when a professional gives another individual access to your information without your permission, this is known as breach of confidentiality. Your permission, or for another good cause. A violation of trust may be quite devastating, if you believe a professional has violated your privacy, investigate what transpired and why information was disclosed. Obtain a copy of the organization’s confidentiality policies. You have the right to file a complaint if you are dissatisfied with the professional’s explanations or believe the organization’s staff should be able to explain their complaint process to you. An advocate may be able to assist you in filling a complaint. If an organization has violated your rights, you may be eligible to file a lawsuit. Before filling a claim, get legal guidance from professional. Differences-
to have the information you provide with your mental health practitioner kept private within state and federal laws. Unless the law compels it, communications between mental health doctors and customers are usually kept private. Mental health practitioners will tell you of any legal exceptions to confidentiality, and if one does occur,
they will only release the information that is necessary by law. Exceptions to this rule include, but are not limited to: Abuse of a child; abuse of an incompetent adult; HIPAA regulation compliance; certain rights you may have relinquished when contracting for third-party financial coverage; court orders; and substantial threats to self, others, property.
