(5 min. minimum) Explain why the study of ethics is important for criminal justice professionals. (CO 1) (2) Criminal justice professionals need to study ethics due to their varying roles in discretion, authority, and power (Pollock, 2019). Ethics needs to be implicated in the decision-making process because the more power a profession holds, the more ethical standards need to be stronger to be upheld. Ethical standards in all aspects can help legislators, prosecutors, defenders, law enforcement, and correctional officers to approach situations ethically through consideration of law, policy, and ethics. Coercion, Special Duties, and Identification of Ethical Issues Do any of the following terms play a role in your chosen case? If so, how?   morals ,   ethics ,   duties ,   superogatories , and   values . (CO 2) (2) Morals Conduct that is considered good and bad (Pollock, 2019). Ethics Studies that constitute good or bad conduct (Pollock, 2019). Duties These are actions that an individual must perform in order to fulfill their responsibilities (Pollock, 2019). Morals are seen in the personal lives of professionals, while ethics is the study of behaviors in professionals. Superogatories Duties that are not explicitly required but are seen as morally good (Pollock, 2019). Values Characteristics which are proportional to the way a criminal justice professional might behave (Pollock, 2019). Describe how other ethical systems define what is moral – specifically, religion, natural law, ethics of virtue, and ethics of care. Did any of these systems play a role in the case you chose? Did you personally choose the case because of your own beliefs in any of the following systems? (CO 3) (2) Ethics of Virtue Ethics is based on the characteristics someone possesses and their virtues (Pollock, 2019). Other virtues might consist of good temper, truthfulness, and friendliness (Pollock, 2019). Ethics of Care This is the study of morality based on human relationships and needs, like a natural response to care (Pollock, 2019). Religion Moral ethics are based on God’s will or the Bible (Pollock, 2019). Natural Law Morality is naturally derived without any outside influences besides the universe. In the case of Anthony Maldonado, Ethics of Virtue and Natural Law can be associated with Maldonado's actions in this theft case. According to the Office of Public Affairs, several officers involved wanted to bribe the victim into withdrawing their complaint, and this plays into one of the Six Pillars of Character.
Police Officers are held to a higher standard, on a solid foundation of trust in the community they protect. These officers consider themselves above the law, and this can be in consideration of Natural Law and the belief that the power that they hold as police officers allows them to use that power for their benefit. What type of justice plays a role in the case you chose (CO 4) (2) Corrective Justice In terms of Maldonado’s actions, he was initially Do any of the three major theories that attempt to explain behavior play a part in the case you chose? If not, why? If so, how? (CO. 5) (2) Does the justification for police power and the basic ethical standards that derive from this justification play a role in the case you chose? If so, how? If not, why not? (CO 6). (2) The justification for police power and the basic ethical standards that derive from this justification plays a role in this case because, under a social contract, citizens give up parts of their rights for protection. Identify the differences between the formal ethics of law enforcement and the values of the police subculture. In the case presented, do the differences between formal ethics and the subculture lead to an ethical dilemma? How? Why? (2) Principles of Formal Ethics of Law Enforcement… Fairness, service, importance of law, and personal conduct (Pollock, 2019). Police Subculture consists of… The socialization of officers and their work environment ultimately forms officers' perspectives from the inside (Pollock, 2019). Yes, the differences between formal ethics and subculture lead to an ethical dilemma because Maldonado and other officers he had socialized with had agreed to bribe the victim to retract his claim. This loyalty to one another goes against the importance of law and applying it to the process the officers went through to steal money and bribe. Present the ethical issues involved in proactive and reactive investigations. How did these issues lead to the ethical dilemma presented in the case. (CO 8). (2) Proactive Ethical Issues Witness and informant reliability, informant protection, entrapment and creation, and rights violations (Pollock, 2019). Reactive Ethical Issues Objectivity and deception (Pollock, 2019). Maldonado pursued asset forfeiture, and the officer stole money from his victim during a traffic stop because they knew they had a chance of financial gain during this traffic stop. Describe the types of police/correctional/legal office corruption. Which of the types of corruption was presented in the case you chose? (CO 9) (2) Police Economic abuse and abuse of authority
