How the Criminal Justice System Works in the United States Law Enforcement The Court System What is the different law- enforcement agencies at different levels? Local and County as well as State and Federal What are the jurisdictions of different levels of law enforcement? What are the different court systems in the United States? Our court system is broken into many parts. Depending on jurisdiction there is state, county, local and federal courts. What are the jurisdictions of the different court systems in the United States?
Law Enforcement The Court System Local police handle all calls, and duties within the locality they are in ie: City of Ocala Police, Country, is responsible for all duties within the county and can assist within the city limits as well with permission request of city. State police patrol the state and primarily are responsible for state road/highway patrol and investigations. Federal police (such as FBI, ATF and ICE) are responsible for crime that is related to each particular jurisdiction and federal law enforcement also have jurisdiction over all levels of law enforcement. How do law-enforcement officers apply discretion? Law enforcement discretion allows officers to make decisions based upon what the situation at hand circumstances. LEOs can perform duties and act accordingly under the circumstances the situation requires (within the law) and situation at hand merits. There is district, supreme, appeals, traffic, juvenile, drug, criminal, traffic, and bankruptcy and civil. Circuit (State) result is not favourable to the Court of How might a case progress through the courts? If a defendant is found guilty in the criminal court system, they have the right to ask for and file reconsideration. The procedure to do so is called an appeal. Appeals court is a specific court that hears cases that have already been heard and sentencing imposed in a criminal court. If circuit court of appeals is not in their favour, they can appeal to the Supreme court which is possible for further consideration, should they decide to hear the case and decide which is final. There is not another type of appeals process. The Supreme court is the last line of the appeals process in the court system of the United States of America
The Corrections System How do different operating methods of corrections systems in the United States function? Address the following operating methods: o Public: These facilities and run and overseen by the government and funded by local, state and federal tax dollars. All decisions regarding population, policies, release, how time is served is made the jurisdiction of the facility. Public facilities also are more transparent as they are funded by tax dollars and constituents (taxpayers) expect this as well as accountability. o Private: The facilities are becoming more commonplace as the day-to-day running is taken care of by the facility owners vs the government. Such facilities are less rigid, less transparent regarding haring the information regarding data of staff, inmate population, budget etc. These companies and privately funded and not by the government. o Local/county jails are run by the country sheriff. City holding cells within a police department are only temporary for holding and defendants are transferred to a county facility awaiting bond, trial etc. o Federal facilities are always run and
