ETHICAL VIOLATIONS
ED 6823 Education and the Law
September 2022
EXAMPLES OF ETHICAL VIOLATIONS THAT MAY RESULT IN
ADMINISTRATIVE ACTION
A teacher begins working in another school district (B) that impedes with her current contract at school district (A). The B contract begins at 1:00 PM, while school district A’s contract ends at 4:00 PM. According to the Oklahoma Teacher Code of Ethics this is contract abandonment. A teacher at Fictional Middle School has a seventh-grade class of twenty-
nine students. One student in particular, Sara, is behind a few grade levels in reading. Her report cards and other data show that the student has struggled throughout her elementary career. Sara is a star basketball player; however, her reading grade keeps her ineligible for competitive play. Her parents approach the
teacher and offer him $1,000 a month to give Sara passing grades until the basketball season is over. If the teacher were to take the money, he would be in violation of Oklahoma Administrative Code (OAC) 210:20-29-4, which states “in fulfillment of the obligation to the profession, the education shall not accept any gratuity, gift, or favor that might impair or appear to influence professional decisions or actions”. Mr. Smith is a certified fifth-grade teacher working in a public school. He dislikes one of his colleagues. He spreads a vicious tale about this colleague
malicious lies about her, claiming drug abuse, alcoholism, and boasts about his own qualifications, overexaggerating them. Mr. Smith is in violation of Oklahoma Administrative Code (OAC) 210:20-29-4, which states “in fulfillment
of the obligation to the profession, the educator: shall not misrepresent his/her professional qualifications” and then goes on to say, “shall not knowingly make false or malicious statements about a colleague”.
PRINCIPAL MEETING
After speaking to my school principal, he believed that the most common ethic issue plaguing our state currently was the abandonment of contract. Our school district has started offering incentives to keep teachers and other staff from semester to semester. For example, if we maintain our employment until the end of the first semester, we will receive $1,000 during Christmas Break, and
if we stay until the end of the school year, we will receive another $1,000 in June
of 2023. He also believes that instructional ineffectiveness is another ethics issue
that is becoming increasingly commonplace due to the uptick in emergency and alternatively certified teachers due to the lack of qualified and certified teachers. He gave me the green light to meet with as many teachers as I needed to.
