Issue

Is DMCC liable for Klink’s injury _ /2
Law
-
Occupier’s liability: An occupier of property has a duty to exercise whatever reasonable
care, given the circumstances, to ensure that anyone using the property, including that
person and anyone with property there—whether or not that person enters the prop-
erty—will be reasonably safe.
_ /3
Analysis
-
In this case, the Dusky Meadows Country Club may have a duty to make sure that the
routes in the parking lot and other areas of their property, including the golf tourna-
ment players, are fairly safe. The black iron posts that are embedded in the asphalt
route and are there to stop golf carts from driving in the parking lot could be considered
a danger.
