2 Research To ensure that the facility is properly following all required guidelines with the new EHR, we must first understand the different laws and regulations. The first one we will be looking at is the AHIMA Code of Ethics. The AHIMA Code of Ethics is designed to help HIM professionals safeguard health information by maintaining ethical obligations. According to AHIMA, “violation of principles in the Code of Ethics does not automatically imply legal liability or violation of the law. Such a determination can only be made in the context of legal and judicial proceedings. Alleged violations of the code are subject to a peer review process. Such processes are generally separate from legal or administrative procedures and insulated from legal review or proceedings to allow the profession to counsel and discipline its own members. Although in some situations, violations of the code would constitute unlawful conduct subject to legal process” (AHIMA House of Delegates, 2019). The next guideline we are looking at is the CMS Meaningful Use incentive program. According to the National Library of Medicine, “the CMS provides a financial incentive for the “Meaningful Use” of certified EHR technology to achieve health and efficiency goals. In addition to a financial incentive, other benefits of complying with Meaningful Use guidelines include a reduction in medical errors, improved availability of patient medical records and data, reminders and alerts, clinical decision support, and e-prescribing/refill automation” (Anumula & Sanelli, 2012). Both AHIMA and CMS have created guidelines and programs that help not only ensure healthcare employees safeguard health information, but also incentivize those who do. Moving into more regulatory aspects, according to the Joint Commission, their, “standards are the basis of an objective evaluation process that can help health care organizations measure, assess, and improve performance. The standards focus on important patient, individual, or resident care and organizational functions that are essential to providing safe, high-quality care” (Joint Commission, 2023). Finally, looking at one of the most known regulations, HIPAA, also known as the “Health Insurance Portability and Accountability Act of 1996 (HIPAA) required the Secretary of the U.S. Department of Health and Human Services (HHS) to
3 develop regulations protecting the privacy and security of certain health information” (Office for Civil Rights (OCR), 2022). All these programs, guidelines, and regulations work together to help ensure the overall safety of healthcare data. Questions Some important questions/topics that will need to be evaluated and addressed during the post- implementation phase include the following: Facility Culture o What did the facility learn about their pre-implementation versus post-implementation state? o How many of the providers and staff are currently utilizing the new EHR and all the available functionalities? Moreover, how can we work to increase this volume if it is not already at 100%? o Are there any issues with training or knowledge pertaining to the staff and the usage of the EHR? o What documentation will need to be updated, drafted, or removed as part of the implementation process? o Is the facility able to capture all data within the reports or is additional data needed? If so, what data is needed and how can this best be obtained? o Has the facility or employees experienced any negative effects from the implementation (i.e., slower work, difficult maneuverability, etc.)? Infrastructure o How is the network holding up and what issue(s) are being noticed since the implementation?
