Bill of Rights Scenarios Read each scenario and using your Bill of Rights notes decide which Amendment from the Bill of Rights are being violated. Scenario One: During a time of peace, a few soldiers from the Army come into your home and announce that they are going to stay in your home for a week and you must provide them with a bed and food. What Amendment is being violated? Amendment 3 Why is this a violation of that amendment? That is a violation of the 3rd amendment because it states that “In peacetime citizens cannot be forced to house soldiers. In wartime, this can only be done in a lawful manner” and the soldiers are forcing the residents to stay and provide them. Scenario Two: You have been accused of robbing a bank. You go through a trial and are found not guilty. Five years later, with new technology, there is new evidence against you. You are notified that next month a new trial will be held against you for the bank robbery. What Amendment is being violated? Amendment 5 Why is this a violation of that amendment? It is a violation of the amendment because it states that “You cannot be tried twice for the same crime (Double Jeopardy)” and he/you have been tried twice. Scenario Three: You are very involved in your religion. Every Thursday, you attend services in a building that was built from donations and is on your own private property. The city decides to pass a law that forbids you and your members from worshipping in your building or anywhere. What Amendment is being violated? Amendment 1
Why is this a violation of that amendment? It is a violation of that amendment because in amendment 1, you have “freedom of religion” but the city is forbidding that. Scenario Four: You Are convicted of a minor traffic violation, but instead of paying a small fine, they take away your driver’s license for life. There is no way you can ever get it back. What Amendment is being violated? Amendment 8 Why is this a violation of that amendment? This scenario is a violation amendment 8 because the amendment states Bail (money paid to get you out of jail till your trial), fines, and punishments must not be cruel, unusual, or excessive” and the police that are taking away their license is a very excessive punishment. Scenario Five: You Are accused of a crime, but no one will tell you what it is. You are immediately arrested, put on trial and found guilty. You are put in prison for four years. You are never told what the crime was or who accused you. What Amendment is being violated? Amendment 6 Why is this a violation of that amendment? This scenario is a violation of amendment 6 because amendment 6 states “know the charges against them” but the person was not given any information on the crime he possibly committed or who accused him. Scenario Six: You are a 22 year old living in a large city. Recently there have been a number of break-ins and assaults in your neighborhood. You go to a local gun store to purchase a handgun for your personal protection. The owner of the store tells you that the city police department has told them not to sell any more handguns to anyone till
further notice. What Amendment is being violated? Amendment 2 Why is this a violation of that amendment? This scenario is a violation of amendment 2 because amendment 2 states, “own firearms (guns)” (right to own guns and other weapons) but the city police is prohibiting people from owning a gun. Scenario Seven: You hear a knock at your front door. When you answer you see two policemen who inform you they are searching for illegal narcotics (drugs) in your neighborhood. They tell you they are going to enter your home and search for narcotics. What Amendment is being violated? Amendment 4 Why is this a violation of that amendment? This scenario is a violation of amendment 4 because amendment 4 states that “ People are protected from arrests, searches of their home and properties, or seizures of their property without good reason” but the police are attempting to search the house without a warrant or good reason. Scenario Eight: Your neighbors’ maple tree fell down in a storm and hit your bicycle you were storing at the side of your home. The bike is damaged beyond repair. The cost of the bike was $600. Your neighbor will not pay for a new bike. You sue your neighbor in civil court, but the judge tells you your lawsuit is ridiculous and dismisses the case without resolution (a decision). What Amendment is being violated? Amendment Violated: 6 Why is this a violation of that amendment?
