Research the state specific law regarding Psychologist to client
confidentiality for the state you are in (this of course will be Missouri
for most of us!). Look for key words like: Privileged communication,
licensed counselor, licensed, psychologist,
Provide a copy of the law as well as a link to the resource where you
got the law from.
The statute states:
(3)
A licensee shall keep confidential his/her therapy relationships
with clients including information obtained from this relationship with clients with the following
exceptions:
(A)
When the client gives written consent;
(B)
When the client constitutes a danger
to him/herself or to others;
(C)
When the member is under court order to disclose information;
or
(D)
When required by law.
Then answer the following in at least 75 words:
1.What does this law allow you to do, not to do?
The law states that a patient has the right to remain
confidential unless falling in one of the four categories stated
above. This requires that on a regular basis, a psychologist
must keep anything in the session with a patient confidential
unless it puts someone’s life in harm's way. This includes not
being able to disclose whether they serve that client or not.
2.Why is it important for you to know the laws regarding your
profession as a counselor?
I would say personally this is very important when going into such a
profession. This allows your boundaries to be set in stone and
mapped out in black in white so there is no confusion. The laws are
a good set of boundaries for any profession especially when it is
someone who is new to it.
