For the fiscal year ending 2021, the total monetary payouts were $350,700,000. Question 2: Can I file? Nine months ago I was refused a job. I think it was because I am Italian. Can I file a complaint with the EEOC? Provide a rationale for your response to reflect support for the response. The issue in this scenario is potential discrimination based on national origin, specifically being Italian. Question 4: Sexual harassment My male co-workers are constantly addressing the body shapes and attire of female workers. In some instances, they are rating them on their looks and many of them are unaware that they are being discussed in this manner. On one occurrence, they took photos and shared them in email exchanges so that could discuss more privately. I feel very uncomfortable with this behavior and want to file a complaint.
Yes, this scenario is classified as sexual harassment. The form of harassment in this case would fall under the category of hostile work environment. By discussing, rating, and taking photos of female co-workers based on their appearance, the actions in the workplace were of a sexual nature and interfered with the employee’s environment and ability to work. Management should take immediate action to address this observed behavior by establishing a clear policy to all employees. Question 5: Leave time I am one of 25 employees in my company. I want to have a baby but my boss says that the company will not grant me the six-week leave I'm requesting. Can they do this? In your answer, provide a rationale for your response. No, they cannot do this, as it violates an EEO right. The issue is pregnancy discrimination, which is protected under the Pregnancy Discrimination and FMLA. It is the woman’s right that the length and dates of leave time be made by her and her doctor. The employer, however, has the right to ask for supporting documentation regarding leave time.
