Any person who uses any drug for the purpose of preventing conception shall be fined not less than 5o dollars or imprisoned not less than 60 days nor more than one year or be both fined and imprisoned. How did other previous cases impact the ruling the Griswold case? There were 2 cases before that argued that a patient’s life was at stake and the other one was that they wanted declaratory judgment that the law could be forced against them. When the law reaches into the bedroom and prevents the wife and husband doing what they want to do which seems to be an invasion on liberty. What is the rational basis test? They ask questions as to if a law is constitutional. Like if it has a race distinction or if it touches a fundamental right. Why was it important for Griswold's argument for the court to interpret the right to privacy as a "fundamental right?" So that the court will take a good look at it and deem it to be unconstitutional for such a law to be in place. How does this case relate to the balance between individuals' right to privacy and a state's power to make laws that govern health, safety, welfare and morals? The case makes it so the states powers to make a law don’t interfere with a persons right to privacy as well as making sure a law doesn’t prevent them from seeking the proper medical attention that they need.
