Running Head: CONFLICT RESOLUTION 1 Conflict Resolution Ohilda Ortega Kaplan University Ohilda Ortega
Conflict Resolution 2 In the case of ExtremeNet vs. Allen Lopez, I believe that Allen Lopez was in the wrong for his actions. Though his satire on his website was a way to express his distaste with ExtremeNet and their policy, Allen Lopez is an employee of ExtremeNet and therefore is setting an example of the company on a whole with his website. Though his website involves a fictional company treating their employees badly and having abusive management methods, it is to be assumed that the satire was based off of ExtremeNet because he worked there. If the website displayed a satire about a coffee shop and their day to day and he worked at a Starbucks, one would assume immediately that he was talking about Starbucks. The same can be assumed here for ExtremeNet and his employment there. Mr. Lopez should be forced to take down his website and remove all the satires from any other sites he has displayed them on. Though he did this satire on his own time at home and not on ExtremeNet’s time, the satire bears a resemblance to said company and should be taken down. In return of this, any legal action will be dropped as long as he complies and does not start up the website again if he should ever leave ExtremeNet. If he fails to do this, then legal action can be taken for defamation of character by ExtremeNet. If Mr. Lopez agrees, he should then be allowed to continue his employment with ExtremeNet if he so wishes as long as he again agrees to take down the site. In return, ExtremeNet will not discriminate towards him for future positions and/or compensations and promotions. If he decides to part ways with said company, this does not give him the right to keep the website running, as this is a defamation of character towards ExtremeNet and could result in legal action. With all the above being stated, this does not mean that ExtremeNet is resolved of any wrong doing. ExtremeNet should listen to Mr. Lopez’s concerns about the company and Ohilda Ortega
