Ethical Dilemma Devitree Gulabram Liberty University CEFS501: Ethical and Legal issues in counseling 7/2/2023
In the video :Who record” the ethical dilemma presented The counselor professionalism and her ability to uphold certain ACA code of ethic standard when it comes to releasing client record to client and referring them to other counselor when the current session are not helping the client comes into question. (Whose record: Pearson education, inc. ) https :// watch.liberty.edu/media/t/1_6fm397ry Ethical Dilemma
Main problem: Client wants to terminate her current sessions and wants to see another counselor because she feels she is not being helped. Secondary Problem : Client was access to her record including all notes the counselor has taken. ethical, legal, clinical problem: The ethical problem in this scenario is the counselor is hesitant in willingly granting the client request. professional problem : The client stability seemed questionable when the statement “ what meaning do you attach to seeing a counselor every three to four weeks?” was made. This problem is related to the client. The client feel like she is not being helped and when certain comment are made about her seeing different counselors, she is observed to be defensive, angry, and resentful. Step 1: Identify the Problem
According to the ACA B.6 e. Counselors provide reasonable access to records and copies of records when requested by competent clients. In the scenario, the counselor seems hesitant in giving access to the client to obtain her record records. This standard was violated because it seems like the client has to defend herself when she ask for her record. Instead of being told yes she will get her record, I(the counselor) made it seem like, giving her the record, would not be to her benefit. Standard B.6.f. states when clients request access to their records, counselors provide assistance and consultation in interpreting counseling records. There was no observation of the client being assisted or being offered assistance of understanding how to get her record or how to understand it. Federal code: 45 C.F.R. § 164.524(a)(1) (Security and Privacy, 2014) mandates that clients have a right of access to their records. 45 C.F.R. 164.524(b)(2) (Security and Privacy, 2014) mandates that providers give clients access to the designated record set within 30 days from the request. Step 2: Apply ACA Standards & State Codes
