Responding to Ethical and Legal Issues
Instructions
To prepare to complete the prompts below, first review the case examples corresponding to your specialization in the media piece, Responding to Ethical and Legal Issues – Case Study, and then select an ethical decision-making model. To aid in your selection, first review pages 15–18 of the Ethical, Legal, and Professional Issues in Counseling text and this week’s readings. You can also choose an ethical decision-making model from a current, peer-reviewed article in a professional counseling journal of your choice. Some examples include:
Practitioners Guide to Ethical Decision Making (
https://www.counseling.org/knowledge-
center/ethics/ethical-decision-making
).
Link to white paper: https://www.counseling.org/docs/default-source/ethics/practioner-
39-s-guide-to-ethical-decision-making.pdf?sfvrsn=f9e5482c_12
Finally, complete the prompts that follow.
Analysis of Ethical Decision-Making Model
Identify the most appropriate decision-making model for your case:
Practitioner’s Guide to Ethical Decision-Making: By Holley Forester-Miller, and Tomas E.
David. Justify why it is the most effective model to use in this case:
This model is appropriate for the case because of the five principles of the model which are autonomy, justice, beneficence, nonmaleficence, and fidelity. Which will provide a guidance for what to do in the situation with potential child abuse and or neglect.
Explain why this model is a better choice in comparison to others and give examples to illustrate
the effectiveness of the model:
In autonomy the belief is that people are free to make their own decisions, unless they are making decisions that could harm themselves or others. In Simons case she uses marijuana
and in the state of Utah the only time medical cannabis is prescribed for mental health is for 1
PTSD, which does not sound like she has so it would be safe to assume she is obtaining it illegally and using it illegally in the state of Utah, and using the substance when she is supposed
to be taking care of her child whether asleep or not could be considered negligence due to her being under the influence of an illegal substance putting her child under potential harm. In beneficence the responsibility of the counselor is to prevent harm, and any harm that could come to the child due to Simon being under the influence is the counselor’s responsibility.
Application of Ethical Decision-Making Model
Identify ethical and legal dilemmas:
Smoking around the child, must report as child endangerment. Distribution of drugs, not something I must be mandatory to report, but in the case of a police investigation with a warrant I would have to disclose. List the specific ethical codes, standards, or laws you would use to determine your response.
A.4. ACA
B.2.a. ACA
ACA Preamble
76-5-112.5 Endangerment of a child or vulnerable adult: States that exposing a child
to the smell an odor of a controlled substance from use is considered child abuse and endangerment.
58-37-1 Utah Controlled Substances Act: Provides a list of all controlled substances. Explain how these codes, standards, or laws will influence your choices:
As the Utah law states marijuana smoke exposure to minors is considered an endangerment of a child which is also abuse, and as I am a mandatory reporter of child abuse, I would have to report it to CPS.
Apply the selected model and include specific examples that illustrate the actions you will take.
