M169- MEDICAL LAW- CHAPTER 4 WORKSHEET
1. Murder is a crime. How does murder differ from euthanasia? Do the courts treat the two
differently? Be specific in your answer-
25 POINTS
Murder is defined as an act done with intent to kill the victim. Euthanasia is defined as an
intentional action or lack of action causing the merciful death of someone suffering from a
terminal illness or incurable condition. The courts do treat the two differently, where penalties for
acts of euthanasia tend to be more lenient than those for murder.
2. How is the medical office affected by statutes and regulations on child and elder abuse? Be
specific in your answer-
10 POINTS
All states require that all medical offices and health care providers report patient injuries that
come from child or elder abuse.
3. A patient who has not paid a bill has come to the emergency room for medical treatment.
While there, a medical assistant notices a large amount of money in her purse. The medical
assistant tells the security guard. The guard stands at the patient’s room and refuses to let her
leave until she pays some money toward her bill. Can the patient file charges against the
hospital? If so, what will the hospital be guilty of and why? -
25 POINTS
4. In most states, physicians are mandated to report child abuse. Following are two hypothetical
cases involving child abuse. Determine whether you would report any of these cases as child
abuse.
Briefly,
but with specificity state your reasons
20 POINTS-
The dirty house case: Mr. and Mrs. Jones and their two preschool children, John
and Mary, live in a decrepit house with three large dogs and a number of cats. Mr. Jones works as
a laborer. Mrs. Jones is not employed outside the house and does nothing inside either. There is
trash all over the house and many cockroaches. The dogs go freely in and out, and the cats use
the piles of old newspapers as litter boxes. The smell is horrible. John and Mary are extremely
dirty at all times. They seem to eat junk food a lot. They have no toys and play with various odds
and ends. However, aside from runny noses, they appear to be healthy and developing normally.
20 POINTS-
The truant case: Bobby, age 8, skipped school several times. A neighbor told his
father about it, but when his father confronted the boy, Bobby lied, saying he had gone to school
every day. The father viewed these as serious offenses on Bobby’s part and he punished Bobby
by beating him with a leather strap hard enough to leave marks on the back of Bobby’s legs.
