Recent case–ruled that the district court's ruling should stand in a case that convicted and
sentenced a person accused of stealing and using people's credit cards from and in different
states. The convicted thief appealed the sentence of 20 years in federal prison as extreme
punishment in violation of the Bill of Rights.
How is your role in government different from an elected official?
Since I was elected by the president and approved by the senate, I serve life term, unless
impeached by the government. Elected officials have a certain time period with their position and to
get elected they had to go through elections, campaigns and more. Compared to what I must go
through, the process is different. I also hold a lot of power as well, I can make a law unconstitutional,
which later changes political and public laws. Due to this power, federal judges have to go through
many tedious procedures, debates, and interviews.
How is it the same?
All officials, including myself, work in the same government to benefit the country. Everyone’s job, as
different as it may seem, is important because without one another the country wouldn’t work the
same way. We all work to better the country and make it a better place.
Do you think judges should be elected? Explain why or why not.
No, I don’t think judges should be elected. Having an election for judges will compromise them more
with the people, this might influence the decisions we have to make. Even though we work and
serve the citizens of the United States, we need to work by following the constitution and the laws.
Having the president elect us and the senate approve the decision disconnects us from the public a
little more, this way allowing us in some way to not follow our decisions upon what the people think
and follow more what the constitution says.
Explain the meaning and process of judicial review.
Judicial review is one of the powers that federal judges hold upon receiving the position. It consists
of the federal courts having the power to review laws of congress and acts of the executive branch
with the possibility that they would make them unconstitutional.
Please explain the role of judicial review in a case you recently decided.
During my recent case I had to decide on whether to change or keep a 20-year prison sentence of a
thief who stole and used people’s credit cards across different states. I had the power to change the
person’s punishment into a shorter sentence, and even supported them that the sentence was a
violation of the bill of rights as they stated.
