: What are the primary initiatives implemented as a result of the PATRIOT Act. How do you believe government can best balance security and civil liberties?
Thirty days following September 11th attacks, the Patriot Act was passed. The Patriot Act was followed by a large number of extensive policies and executive orders from the federal and state governments accompanied by an immense overhaul. It was developed to enhance the capabilities of United States law enforcement to identify and mitigate terrorism. The aim is to improve Homeland Security by the following:
Allows law enforcement to monitor and wiretap to prosecute offenses linked to terrorism;
Enables federal agents to request authorization from the court to use wiretaps to identify a potential terrorism suspect
Enables delayed notice search warrants to avoid a criminal from discovering that they are a suspect
Permits federal agents to seek permission from the federal courts to obtain financial documents and business records to assist in national security terror investigations and prevent money laundering for terrorist financing.
Improves the exchange of knowledge and intelligence between government agencies
Imposes harsher sentences on suspected terrorists and those who conceal them
Permits search warrants to be issued in any jurisdiction where terrorist activities happen, no matter where the warrant is served
Terminates the statute of limitations on evident terrorist activities
Tougher laws on aliens trying to enter United States involved in terrorist activities
Provides support to terrorism victims and public safety officers involved in combating or preventing extremism or reacting to terrorist incidents
Offers aid to terrorism victims and officers involved in the prevention, responding, and investigation of terrorism
The best way to balance security and civil liberties is not to balance them at all. It is a matter of insisting on policies that maximize both as far as possible. Benjamin Franklin’s memorable said,
“They that can give up essential liberty to purchase a little temporary safety deserve neither liberty nor safety.” Policies that make the nation more secure, especially against foreign threats, do not essentially undermine the freedom of its people.
