Vignette 2.       Mr. J., a legal alien from Mexico, arrived in the US six years ago at age 20. Who is living in downtown streets, sleeping in doorways, begging for food, and taking an apple from Billy’s Market, was referred by the court to a local psychologist for a comprehensive evaluation to confirm a previous diagnosis of mental health retardation and dysthymic disorder. A request for an evaluation to assess to what degree this diagnosis may have contributed to the recent loitering, pandering, and petty theft charges.       Forensic psychologist responsibility is to conduct screening or assessments of court defendants and to examine the mental states of standing trial. A psychologist’s role in court is to provide expert opinions regarding an individual’s competency as a witness or to determine the client’s competency to stand the test. The outcome of their evaluations can assist the legal decision making decision process. Psychologists can give an informed opinion on whether a suspect knew right from wrong at the time of the crime and even whether a minor is truthful in recounting an unlawful act (Florida National University, 2020 ). Ultimately, one of the primary
objectives of the psychologist is to protect the rights of each client they see and provide one-on- one therapy sessions.      Problems can cause Mental Retardation or Developmental Delay before a child turns 18 or even birth, injury, disease, or brain problems (CDC, n.d.). Dysthymia or Persistent Depressive Disorder (PDD) is a chemical imbalance in the brain. It is a mild but long-term form of depression. A low mood occurs for at least two years, along with at least two other symptoms of depression. Many factors can contribute to this type of depression, Persistent Depressive Order (John Hopkins, n.d.). These include environmental, psychological, biological, and genetic factors, trauma, and chronic stress (John Hopkins, n.d.). These feelings might interfere with relationships, school, work, daily activities, and low self-esteem, feel like a failure, and feel hopeless, and may last for years. Although not severe as major depression, the current mood may be mild to moderate or severe (Mayo Clinic, n.d.). If left untreated, it can lead to the inability to form long-lasting relationships or perform well at work, and it is linked to cardiovascular disease and increases the risk of developing major depressive disorder, anxiety, and somatoform (Montijo, 2022.). Ethical Standards, Federal Law Violation, and California Law      According to the Laws on confidentiality, including California’s Laws, the therapist Violated the patient’s rights in many ways. It is expected of the psychologist to seek informed consent and for the client to have a clear understanding of the range and outcomes that could result from the potential assessment (California Board of Psychology Laws and Regulations (2021). 
     The therapist discriminated against the patient after learning the client was homeless, a legal alien from Mexico, by not considering those factors upon performing the assessment. The therapist violated ethical standard #3, Human Relations. 3.01 Ethical Standard Code of Conduct Unfair Discrimination. Their work-related activities as a psychologist involved unfair discrimination based on ethnicity, culture, language, and socioeconomic status (Ethical Standard Code of Conduct) 3.07 Third Party Request for Service. The psychologist provides services as a therapist and consultant for the court system and not as law enforcement by recommending “Mr. J should be tried and found guilty, and the maximum sentence should be handed down that would provide a structured environment where Mr. J. might learn action-consequence relationship.”      9.06 Ethical Standard Code of Conduct. Interpreting Assessment Results by not considering the purpose of the assessment results, the purpose of the assessment as well as other factors can impact the test results, such as situational. Personal linguistic and cultural differences might affect psychological judgment or reduce the accuracy of their interpretation of the test. In this case, the therapist did not consider how PDD and mental delay can affect the assessment outcome.
