Intellectual property is a general term that includes all products of the human mind. Accuracy is a term used to describe the authenticity and accuracy of information which is being collected and processed. Accessibility describes the right to access information and payment of fees to access it. Legal Environment of E-Commerce Companies operating on the web must comply with the same laws and regulations required for all businesses. Failure to do so may result in the same penalties as a brick and mortar business. A business on the web immediately becomes an international business. Consequently, web businesses are required to comply with many more laws. Borders and Jurisdiction Geographic boundaries in the physical world usually coincide with acceptable legal and cultural boundaries. The culture of a society and what types of actions are acceptable drive the law making processes. A web based business is not limited by the physical boundaries of the world. Personal Jurisdiction Personal jurisdiction is usually determined by the residence of the parties. Jurisdiction on the internet is more difficult to define, assert and establish than they are in the physical world. Buyers and sellers may be in different countries. In the case of Anthony, a New Jersey resident and owner of a waste disposal company in the state of New Jersey, and his two business associates, Paul and Silvio, whom suffered severe injuries due to a motor vehicle accident caused by a negligent truck driver; they have great standing to sue against the neglectful driver and the company associated with the ownership of the vehicle. Before deciding on whether or not to engage in e-Commerce, a business must look at several factors in order to determine if they are ready and able to do everything needed in order to make it successful. Companies should initially perform a SWOT analysis in order to determine if selling products online would be beneficial to the overall company. They also need to make sure they understand they will be dealing with customers all over the world and are willing to take on the work involved to know all of the legalities involved. The new advances in technology allow businesses to reach different customer bases. This includes buying and selling products over the Internet. The online shopping process is considered e-commerce. E-commerce is made up of different behaviors but for the purpose of this discussion the three discussed are consumer-to-consumer (C2C), business-to-business (B2B), and consumer-to-business (C2B). The different behaviors have different mediums to reach their targeted audience. The message for each behavior persuades a particular audience to purchase a product using that particular medium. There is also confusion regarding what is Constitutionally acceptable in the online marketplace. Many consumers and businesses believed that taxing products over the Internet was not allowed. . This misconception was cleared up in infamous Quill Corp. v. North Dakota case, which created the “nexus” law. This case has greatly effected the taxation of Internet sales. It stated that there must be a large physical presence of a company in a state for that state to lawfully require the company to collect taxes inside the state (Andes & Atkinson, 2013). With the growth of the Internet, many of these misconceptions are attempting to be understood through various forms of legislation.
