The Constitution plays one of the key function in shaping the United States stability and guide the government officials on how the American’s system should structure for future generations to come. In the Constitution, there are many sections the have affect many citizens throughout the nation. Personally, the portion that impacts me personally is Article IV. By using the Constitution’s language as a base, it can guide citizens, such as myself, to learn how to use the power of faith in our lives when dealing with rules and regulations in the government decision making process. This portion stands out to me the most because it explains how protection should be established when conflicts or violences pop into life. In Article IV Section 3, it
The Constitution should change with society. Like all societies, ours changes with time. Like it or not, things will be different in the future. Although we agree with things we are doing now, we may not in the future. Our constitution is ment to be part of a lasting government in the land of the free. If the USA really wishes to be held up to that title, its people must be able to agree, and if needed, change the Constitution.
The Constitution was written by our founding fathers as a way to set up a system to protect the United States from becoming a tyranny. The United States Constitution is guarded against tyranny in four major ways but the three best ways that the Constitution guards against tyranny is with representation, separation of powers, and checks and balances. These three principles helps keep the Constitution safe so that no one person can take control over the United States and that the U.S. does not turn into a dictatorship. One way the Constitution of the United States guards against tyranny is by using representation.
During the 1850’s, the Constitution was originally formed to help facilitate in making our nation unified. It had become a source of sectional tension between states and ultimately contributed to the failure of the Union it had created. This statement is mostly valid. The fact that it had become a source of sectional discord and tension is true. The part that I disagree with is that the Constitution “ultimately contributed to the failure of the Union is had created.” This is just not true because at no point did our Union fail. Using “fail” as part of this statement is so inaccurate and doesn’t put our Country in a good light. Yes, there definitely was sectional discord and tension, but at no period of time in the 1850’s did the Constitution cause our nation to “fail”. The biggest impact that sectionalism had in America was that slavery started off as a political issue and continued to be one until moral issues got in the way. People began to find slavery as more of a moral issue than a political issue. The problem with this is that it is possible to solve political issues, but practically impossible to resolve moral issues, slavery had now been seen as morally wrong and more people had started to believe that whites and blacks were equal as more Political Anti Slavery Abolition groups had started to form.
The U.S Constitution, famously known for establishing America’s national government and providing fundamental laws assuring citizens certain basic fundamental rights was a milestone in our countries beginning. In today’s society, especially with all the turmoil happening between people and governing bodies the rights which the Constitution provides is saving many Americans from being treated poorly or as most would say “unconstitutionally.” The Constitution is simply one of the most distinct and brilliant documents to ever see the light of day. Although some may have little to no knowledge of the Constitution, it
The U.S. Constitution is one of the most unique documents ever written. For over 228
The Constitution is meant to be a living document, one that changes and adapts to the ideals of the generations following the original Framers. This is evidenced by the Nineteenth Amendment which guarantees that American women have the right to vote. During the eighteenth century allowing women to vote would have been unheard of but as the country’s views changed, the Constitution changed with it. Article V of the Constitution addresses amending the constitution and the ratification of said amendments.
Since the terrorist suicide bombed the world trade center and a wing of the pentagon, there has been a change in the relationship between the United States government and the people. The executive branch has taken steps that undermine the principles in the United States constitution. In order to ensure a more democratic society, we have to tell the difference between effective governing and individual freedom. There is one main topic I'm going to talk about how the 1st amendment, 4th amendment, 5th amendment, and 6th amendment are being eroded by the USA PARTRIOT Act which introduced a overabundance of legislative changes which considerably increased the surveillance and investigative powers of law enforcement agencies in the United
Chapter one of the textbook, Constitutional Law and the Criminal Justice System by J. Scott Harr, Karen M. Hess, Christine Orthmann, and Jonathon Kingsbury discuses a historical overview of the United States, or better known as the U.S. Constitution. To elaborate, the textbook educates the reader on why the U.S. Constitution was created, as well as what its main purpose is. Most people know that the U.S. Constitution was not necessarily an original thought by the United States. In fact, it was greatly influenced by the English document known as the Magna Carat (Harr, Hess, Orthmann, & Kingsbury, 2015, p. 13). In addition, the U.S. Constitution was fashioned, mainly, as a binding document to prevent any one person from having complete power in the United
Government has convey the constitution articles regarding guidelines in the bases of the rights of its citizens and law process. Back in the heyday the articles of constitution were laid as the foundation of government restrictions and power distribution. The restriction partied the way of separation between government and citizens. There are 7 articles in place to this day and are in still used to this day. The articles on hand, disturbed power among several branches of government. These articles give no one branch more power than the other. The check and balances are place in order to keep a branch from overindulge too much power over the other. The placement is in place to keep the government from overpowering governmental duties. The articles serves as a backbone for its citizens and are place for the protection of the citizens of the United States. The articles serves to not give on one single branch of government more power than the other, even the president himself. The issue I will be discuss on hand, is the affordable health care act. Which is also known to many, Obama Care. Too many and including myself believe Obamacare infringes the rights of it citizens and bypass the articles Legislative sector, which were violated in the process making.
Article VI of the U.S. Constitution state that laws passed by Congress, and action by the president, must meet the standards of the Constitution. Article VI is intended to state that the rights and liberties of citizens are secure. Unless the government can prove that it has a very good reason to control individual’s freedom. By virtue of being human, all individuals are in possessions of certain natural rights, such as the right to a free trial and freedom of speech, freedom of religion. Civil liberties are freedoms that are guaranteed protection of people from an over-powerful government. Civil liberties are rights that cannot be restricted by government regardless of ethnicity, gender or citizenship. It restricts government actions to
Liptak points out the dysfunctionality of the constitution using the fact that the constitution strongly protects the Right to Bear Arms, but it is weak when dealing with other rights. Some of the rights that are not strongly protected by the constitution include travel rights protection, presumption of innocence, entitlement to food, education and health care. Liptak recognizes the significance of the constitution and understands the important role it played in this country becoming America. But he also understands that the constitution was created because the Articles of Confederation did not give the government enough centralized power and the constitution was the best option. The outcome of this has created a strong urge to preserve and not change the
The purpose of Article Four, Section One, is for all states to respect each other’s laws so the country remains united. If one state does not like another’s laws a fray might occur. For example, the Civil War took place between the states because the Northern states wanted to free the slaves and the Southern States wanted to own them for labor. The purpose of Article Four, Section Two, is for citizens of all states to be treated equally and fairly like all citizens of another. It is unjust if a citizen can perform an illegal action in one state, and it will be allowed in another state. Also, in Section Two, it talks about if a person is accused of a crime in one state and flees to another, they
After the War of Independence, in exchange for the founding of a national government, the U.S. Constitution was regarded as a “masterfully designed cage” that would stop the “beast” of government from “running amok”. The Constitution protected the people from government, and protected subgroups from the dictatorships of majorities.
The constitution, the governing document of the United States, virtually perfect in its creation and given life through the thoughts, worries, and dreams of a few great and very intelligent men, it can be said to be the living law of the land, one that has grown and matured with society and the world of today. This document has performed amazingly in its ability to represent the people of its time and to allow room for interpretation of law in combination with society to allow it to continue to represent the people of the future. Created out of the desperation to preserve a struggling country, this document has been mirrored by others in order to create or recreate governments in many parts of the world. Still, despite of this, it seems that many in power within the United States at this time appear to struggle with the proper interpretation of this living law of the land, and instead manipulate government to achieve personnel agendas or personnel benefit in some fashion, while turning a near blind eye to any influence of constitutionality. So, in response to this, I feel that three amendments should be added to this great document, one out of the spirit of redundancy to illustrate the obvious, and the other two out of necessity to address issues of integrity and stability within government and society. These amendments reflect the issues of term limits to those within Congress, a religious freedom protection clause, and an American Integrity clause; the effects and
The Constitution is a plan for the government that was developed in 1789. The government's role is to protect the people's natural rights and provide security for people. Throughout time there have been changes in society, therefore the Constitution should have changes to fit our society. The body of the Constitution is adequate for today’s society but to help keep our rights safe and to have good security, there should be minor changes to the Constitution. The Constitution is corrupt in today’s society because of technological advances, corrupt government officials, and the federal government has too much power over state governments.
