This is a very misleading AD campaign. When a manufacturer makes a claim that a product can do or will do certain things and it has not been scientifically tested, then that is a deceptive advertisement. There are several dietary supplements on the market today claiming that they will contribute to weight loss, which is misleading also. Before purchasing a dietary supplement, consumers should do their research and also go to the Federal Trade commission website. Although, this is a promotion, there are legal regulations to be followed. This act is in place to outlaw unfair methods of competition and practices that effect commerce, seek monetary redress and other relief for conduct injurious to consumers, and prescribe rules defining with specifically acts or practices that are unfair or deceptive.
Manufactures do have a duty to make consumers aware of their product and the side effects of it. There was zero evidence that the vitamin water documented the effects of a dietary supplement and that it has the same effect as a flu shot. Vitamin water should not be referenced to health benefits without being scientifically tested and approved by the Federal Trade Commission. This is where product liability comes into play, because it

Laws have changed from “buyer beware” to a more strict liability for manufacturing defects that make a product unreasonably dangerous. The damage awards from businesses have reached millions of dollars, and they have sought tort reform state legislatures and Congress in hopes of reducing them. As the market place changes, so does the scope of duty for a manufacturer in reference to warnings or instructions of a product. The structure and components of this environment change, and the requirements for adequacy can often be challenged to meet new demands and
These advertisements about weight loss supplements are not the solution to healthily losing weight. The advertising industry tricks us into buying these supplements, but they do not reveal all the side effects they bring along. An article written by Triplett shows how much money is spent annually in the weight loss supplements’ business in the United States. Triplett states, “Americans spend at least $16 billion a year on nearly 30,000 kinds of dietary supplements, most of which seem safe” (Triplett). But, not all of dietary supplements are as safe as advertisements claim them to be. Unlike over-the counter
In the world of sports it is a competitive place where athletes lay everything they have worked for their whole lives to win the game. Now these athletes have been striving for greatness and dedicating so much of their lives to getting bigger faster and stronger to be able to win some games and ultimately move up in their careers and possibly make a living out of the sport they love to play. Sports rewards players who are motivated and works harder than the other team and stay focused and just dedicate so much to the sport. Now there are shortcuts to becoming bigger and faster and stronger. While some athletes bleed sweat and work as hard as they can and sometimes get changes slowly and far between some athletes will take performance enhancing drugs which will help these athletes take a shortcut and beat out the others who strive to get better. There in my opinion is nothing wrong with athletes wanting to get an upper edge on opponents by getting bigger and stronger but when the athlete uses performance enhancing drugs to get an upper edge I do not agree with this and feel like those athletes should receive some type of punishment.
Product liability law is noteworthy given the variety of defects covered, i.e. defects in design, manufacture, or warning, as well as the variety of types of liability ranging from strict liability to breach of warranty, negligence, or the battery type. given that the different theories of product liability provide or allow different types of defenses as well as damages, plaintiffs have flexibility when determining how to proceed with a
Americans love to eat anything crazy. If a meal that has triple-wrapped bacon hot-dog fried in panko crumbs stuffed cheese that is filled with diabetes, Americans would devour it. Unhealthy foods have been apart of the American diet as a commonality, more than healthy foods should be. Unhealthy junk foods consist of unnecessary fats, oils, sugars, high-fructose corn syrup, MSG, and many more. Healthy foods have been increasingly disappearing from our restaurants every second. However, young people need a healthy diet to live a long and fulfilling life from self-inflicting diseases. Authors like Jane E. Brody, Mark Bittman, Alice Waters, and Katrina Heron all advocate for healthy foods. Jane E. Brody in “Attacking the Obesity Epidemic by First Figuring Out Its Cause” describes the cause of the obesity epidemic and proposes many solutions against it. Alice Waters and Katrina Heron in “No Lunch Left Behind” discuss the accessible healthy foods students are in dire need of instead of the processed trash. Mark Bittman in “Bad Food? Tax it, and Subsidize Vegetables” elaborates on the many benefits from taxing “bad food” and subsidizing vegetables such as reducing healthcare costs, improving health, and many more. All of these authors fight for a healthy American diet. As a fellow human being, this epidemic must be solved and it starts with youth. Many schools’ lunches and available snacks/foods are more unhealthy than to be nutritional. However, schools do try to combat junk food. Based on school data, surveys, and nationwide statistics, unhealthy foods should be taxed and healthy, natural foods should be subsidized and be more available for schools and eventually all people for a healthier lifestyle.
Creatine is a nitrogenous organic acid that occurs naturally in vertebrates and helps tosupply energy to all cells in the body, primarily muscle. It is usually mixed with liquid and isdrank by people who are working out or doing some type of sport. Creatine increases the body’sability to produce energy rapidly. With more energy, you can train harder and more often, producing faster results. Also, research shows that creatine is most effective in high-intensitytraining such as weight training, football, and baseball. Performers and athletes shouldn’t be able to use creatine because there are many sideeffects and risks. The side effects of using creatine consist of kidney disease and failure, waterretention, nausea, cramping, muscle pain, and
Greg a 14-year-old boy living with his parents in the basement. He has to take these off label prescription drug. An off label prescription drug is a drug that isn’t prescription by a doctor or pro. Greg could find these drugs on the streets or even with his family members. Be sure to take your drugs to a doctor and get them copied and your drugs. Greg is taking these drugs to feel better but he doesn’t know if they should be off labeled by a pro or just somebody else. When off label drugs were in the 1980’s it is different than today. It’s different because the drugs used back then were, just for pain. But today we use drugs to get better with an illness or disease. Off label drugs has been used since the 1980’s, supporters and no supporters argue if off label drugs are a good thing or not.
Consumers use a variety of products on a daily basis to assist them in accomplishing a task or completing a project and they expect the product to be properly designed and safe to use. However, in the event that a product is defective and causes injury to the person using it, the manufacturer may be liable for the injury and have to compensate the injured person (s). Companies that manufacture products need to be sure they are doing all within their power to assemble products that are free of defects that could accidentally cause harm and cost the company. Product liability is the
Sue Jozui suggestion to the customers is to boycott these misleading advertisements that do not actualize what the products’ actual purpose will cause or do. With what Sue Jozui has said about these kinds of advertisements, companies only try to get customers hopes and interests spiked up by stating the positive, it is the job as a customer to research a product being endorsed. Whether it is by going online and searching what critics have said about the product, actually testing the product, or getting the product recommended to
Even though people need their prescriptions, the abuse of them is getting out of control and we need to find a way to regulate it better, because it can destroy a family, cause some to become addicted, or even kill them. Prescription drugs are no joke, they can be worse than illegal drugs like marijuana, cocaine, and even heroin. The only difference is a doctor can prescribe these types of drugs. The problem we run into with prescription drugs is there is not enough being done to keep the person from becoming addicted or them selling to others. In 2007 2.5 million Americans abused just painkillers (Drug free world). That is not even including the other two types. Now it is starting to affect teens, one out of every ten teenagers admit to abusing a prescribed drug(Drug-free world).
Many people that are perhaps obese or just want to shed a few pounds quickly are easily persuaded to believe advertisements when they come on the radio or on their television saying that their product will make those extra pounds disappear, but the future buyers that are going to buy and consume the product do not know if it will work
Following the link to “The Stimulife Story,” one can read of the founder and origins of Stimulife 750. (Again, it is interesting to note that the main image on this page is a thin, exuberant woman standing on a scale – assuring the viewer that s/he, too, could be so happy and thin if s/he were to purchase Stimulife.) The company first assures the viewer that the product is a safe and healthy “herbal” alternative as compared to the other weight supplements on the market. The company supports this statement by describing Stimulife’s founder, John Fike, as a hard-working, knowledgeable fitness-expert who wanted to deliver both his parents and the world from weight problems and from the evils of weight-loss supplements. Fike supposedly applied computer technology, fitness expertise, case studies, knowledge of herbal medicine, advice from numerous chemists, and a true compassion for those suffering from weight problems to create Stimulife. One must really wonder how one man, who was not a doctor or scientist but a man with a career in “weight training and kickboxing” could accomplish such a staggering financial and scientific feat. Surely, there is more to this story than the company tells.
Healthy food should be accessible to everyone. If healthy food isn’t available for everyone all it’s going to do is cause more and more health problems. If we made healthy organic food the same price as cheap unhealthy food there would be a big difference in the health of our country. It’s completely unfair to make healthy food too expensive for other people to buy, which causes them to buy cheap unhealthy food, like off a dollar menu at a fast food restaurant. This issue needs to be put to an end.
Dietary supplements are an ever-increasing industry; that includes weight-loss aids, vitamins, herbal preparations, and energy boosters. With these increases, there is an outcry for more control on companies that sell these products. But the FDA only lightly monitors the supplement industry. As a result, some critics feel that the FDA needs to step in and more closely monitor supplement manufacturing to make sure the products sold do what do what the company says or have no negative side effects on the people who use these manufactured goods. Inside these supplements, some illegal substances have been found, and some of these supplements are illegal without a prescription. Furthermore, some companies mislabeled their products with false information that does not include the correct ingredients used on their bottles.
What surprised me the most is that Americans spend an estimated of $5 billion a year on unproven herbal supplements. The reason I’m surprised from this is because the people don’t know what they are actually buying. That they end up spending millions of dollars on something unproven. It also makes me angry because there are people that have no idea about it being unproven and end up taking loans, working overtime, and getting no time to spend with their families. Which is unfair to them and their families.
Just like alcohol, marijuana also plays a big part in violent crime. Studies show “Continued use of cannabis causes violent behaviour as a direct result of changes in brain function that are caused by smoking weed over many years.” (BBC, 2016)
