2 Step 1: The Occupational Health and Safety Act guarantees three fundamental rights to all workers. These include the right to a healthy and safe work environment, the right to refuse unsafe work, and the right to participate in health and safety matters. Employers have a crucial role in upholding these rights to ensure that employees can work in a secure and healthy environment. Maintaining a safe workplace not only protects employees but also enhances the reputation and productivity of businesses. (Canada, 2023) Workers have the right to be informed about health and safety issues that may affect them. Employees have the right to know about all workplace hazards and be provided with the necessary information, education, training, and supervision to ensure their safety. This right must be fulfilled before they start working. Employers must also allow employees to choose the form and method of communication that suits them best . (Winters, 2016) Example I am a Civil Engineer by profession and have worked in construction sites, which I believe are more hazardous. Before we started working, we were given a detailed presentation on all potential hazards on our construction site. We were also provided with educational materials and trained on how to handle those hazards safely. The training was conducted in various forms, including an interactive presentation, written materials, and hands-on practice. It is essential to know how to handle materials and perform your job correctly; otherwise, you will pose a significant safety risk to yourself and others. Workers have the right to participate in decisions that may affect their health and safety. Employees have the right to contribute their ideas and opinions regarding the measures taken by their employer to ensure a healthy and safe work environment. To participate and provide input, employees can become a member of the Health and Safety (H&S) committee, act as an H&S representative for their workplace, report any concerns related to Sher Azam Khan
3 H&S matters that could potentially harm anyone, and suggest ways to make the workplace safer to the committee . (Winters, 2016) Example While working at a construction company, the Health and Safety (H&S) committee was highly active and engaged. As an employee, we could become a committee member or act as an H&S representative for our workplace. This empowered us to report any concerns related to H&S matters that could potentially harm anyone and suggest ways to make the workplace safer to the committee. Knowing that our employer valued our input and took our safety seriously was reassuring. Workers have the right to refuse to do work that may pose a risk to their own health and safety, as well as the health and safety of others. Workers can refuse unsafe work if other safety measures fail. It shouldn't be used as a routine to solve workplace problems. Speak with your supervisor, health and safety committee, or officer first. If your concerns are rejected, your employer may temporarily assign you to other work during the investigation and have another employee do your tasks. (Winters, 2016) Example In a construction site, if you notice a broken safety guard on heavy machinery and your supervisor doesn't fix it, you can refuse to work in an unsafe environment. Report the issue to your health and safety committee or officer. If your concerns are still ignored, your employer may temporarily assign you to other work during the investigation. Step 2: Employers must take all necessary precautions to protect the health and safety of their workers. This involves ensuring that equipment, materials, and protective gear are always in good condition and that workers are provided with adequate information, instruction, and supervision to keep them safe.
