Case Study Although unsure how to go about this due to the vagueness of instruction, I will apply myself and try my best. Meeting Organizer: This person would be the one to organize the start and end of the meeting and to ensure the arguments and overall case flows well in terms of conversation and smooth decision making. This person is like an over watcher. Hearing Officer: Upon hearing arguments as well as opinions from the parents of Garret, the superintendent, school district attorney, and family attorney, it is the hearing officer’s job to decide whether Garret is entitled to receive medical services in line with the requirements set forth in the construct of free and appropriate education under IDEA. Do medical services fall under related services, and to what extent are medical services in need of added physician services outside the regular school health personnel? That’s the question leading the decision. Family Attorney: They must fight on behalf of the family so that Garret receives the medical services he needs to be able to stay in class with all other children. They must argue what the basis of FAPE really means and how the school should be educating all handicapped children with non handicapped children whenever possible. It’s important to note zero reject and how that should be incorporated in this case. School District Attorney: Here it is important for the school district attorney to really highlight the facts laid forth in the case. The law simply does not require the district to pay for medical costs regardless of if the family is asking for the district to cover them. It’s also important to note that whoever is with Garret needs to be a trained health professional with experience in catheterization as well as ventilator maintenance. This is very important because if something goes wrong then the district and whoever is at aid will be held legally liable for any mishaps. It’s also important to note that technically related services only cover those that utilize school health personnel and nothing more Superintendent: I believe in this case; the superintendent would only be asked to speak if they were testifying. It is important for the superintendent to know all the facts of the case and align their facts with that of the school district attorney’s. They must present a uniform front where there are no discrepancies in thoughts or fact. Maybe you could have information on budget, allotted resources for medical services, and time constraints to defend any facts already presented. Parents: Your sole job is to stand completely by your son garret. You will do anything to receive the help that he needs to be able to attend school with kids like him. Remind the court that he has no mental deficiencies and that the only thing keeping him back are his physical impairments which is unfair. Remind the court that you are not a nurse but have still cared for garret and he has turned out perfectly find so far. You are not demanding a doctor but simply just a nurse to be able to assist him in ways that he specifically needs. The person would need to know how to use, plug in, and take care of a respirator and they must be medically trained.
Conclusion: At the end of this case, it was decided that under IDEA and the construct of free and appropriate education for all, Garret will receive the medical professional he needs as well as the funding for it. He too should be able to attend class, socialize, learn, and live a normal life just like the other kids regardless of his physical impairments! The court hopes he might thrive and enjoy school in the way he should!
