State and Federal Laws Human service professionals are faced with difficult decisions daily that affect the lives of individuals. The decisions that are made by the human service professionals must adhere to the state and federal laws. The state and federal laws are based on children's well-being and safety. When child abuse and neglect are reported and the safety of a child is questioned the human service professional begins with making challenging decisions. Human service professionals must uphold and make a priority the state, federal, and standard guidelines for child welfare. The Child Abuse Prevention and Treatment Act (CAPTA) was enacted in 1974 and "is a federally funded program to improve State's child welfare system. To address child abuse and neglect, States utilize the funding to support prevention, identification, and treatment activities" (Department of Social Services). The Child Abuse Prevention and Treatment Act “established state responsibilities for child protection and supported the execution of these responsibilities with new federal money for state programs and national research” (2014). CAPTA gives guidance to human service professionals in protecting children. When a parent, guardian, or caregiver is not meeting the needs of a child Child Protective Services (CPS) intervines. If the parents are found to have caused child abuse or neglect they can have their children removed from the home and they can be punished by the state laws. The children will be placed in the foster care system until the parents meet the required actions given to them. Human service professionals have to make challenging decisions to separate children from their parents, however, the goal of the professional is to provide the children with a safe environment. If parents, guardians, or caregivers are unable to provide that to their children the human service professional must step in and take action.
Ethical Principle When working in the human service field, human service professionals are required to follow ethical standards. Human service professionals "uphold integrity, promote the client and community well-being, and enhance their growth and development" (Allen. B). Ethical standards "provide service without prejudice and discrimination, regarding race, religion, age, ability, language, socioeconomic status, sexual orientation, religion" (Standard 26). Human service professionals hold values of diversity, integrity, objectivity, honesty, and advocacy for social justice for the welfare of individuals. Human service professionals aim for preventive practices and family preservation to help families rebuild. Best Practices The guidelines that human service professionals practice are applied to the decisions they make regarding children. These guidelines are centered around the children's safety. Before removing a child from their home the human service professional must determine what is in the best interest of the child/children. They also have to determine a long-term solution for that child/children. The human service professional must have the skills and knowledge before making any decisions. To, place the needs of the child/children first the human service professional must use an evidence-based process such as asking questions. Legal and Ethical Guidelines The legal and ethical guidelines are to be followed and focus on the safety and well-being of the child/children.
