CJUS 703 Quiz 4 Help 21. What are the four limits to restorative justice? Which limitation is the most troubling? Justify your answer. There are four shortcomings associated with restorative justice. The first problem with it is that it is predicated on an unfinished theory. The theory of the crime is informative, and rather than being made plain, it is left implicit. It is often believed that criminals are stigmatized, rejected, and excluded from customary roles after they have been captured, and that this contributes to the continuation of criminal activity. The second drawback is that the known factors that determine a person's likelihood of returning to prison are not targeted for change. There are certain interventions that are no longer effective because of the way that things are done, and there is a desire to change the way that things are done. The third argument is that the intervention is not enough to modify the behavior of serious offenders. There are programs for making amends, and there are seminars for sentence. The fourth issue is a disregard for the concepts of successful correctional intervention. There is a body of empirical research that demonstrates the steps that need to be taken for a treatment program to achieve significant reductions in the rate of recidivism. The situation in which an offender may attempt to be out due of restorative justice, but they aren't ready to be released or in a treatment program is perhaps the one that causes the greatest reason for concern among the constraints. It is possible that the algorithms are not ready to recognize the falsehoods said by criminals since they have not been in existence for a sufficient amount of time to investigate the roots of a criminal's behavior. -The first limitation stated is the absence of consensus over the meaning of the term restorative justice, which may lead to theoretical and policy confusion as a result of its many identities
-Second, the restorative justice process cannot begin until the criminal confesses to committing a crime; it does not address whether a crime happened or if the suspect is guilty. -The third limitation is that under restorative justice systems, it is easier to achieve fairness than restorativeness. -The fourth and fifth limitations noted are the difficulty in getting or assuring sincere apologies in restorative justice procedures and the difficulties in supporting victims in healing from the effects of the crime since not all victims are affected in the same manner. -The final limitation identified is the anticipation of a restorative justice Nirvana when, in the majority of cases, the procedure yields modest results. Daly concludes by arguing that while face-to-face encounters between offenders, victims, and their communities are a valuable and worthwhile practice, one should not anticipate dramatic tales of healing and goodwill to emerge from these interactions (most of the time).
