2 CASE STUDY CRITIQUE Abstract Investigations into officer misbehavior put officers at a disadvantage across the country. The Peace Officer Bill of Rights was created to prevent departments from conducting investigations without following the proper procedures. Departments and the country should create rules and regulations to support police who are acting morally and to penalize those who are not. This actively demonstrates to society that, despite the fact that cops are tasked with upholding state laws, they are not above the law. Police and agencies are shielded against civil lawsuits and ethical transgressions by the officers by policies and procedures. Numerous law enforcement agencies across the country have revised the Peace Officer Bill of Rights and are enforcing these guidelines uniformly for all officers under their authority.
3 CASE STUDY CRITIQUE Officer Bill of Rights Decision The POBR was repeatedly introduced to Congress but was never approved. A revised version of this bill was sponsored by the House and Senate in 1995 after it had been sent to Congress on numerous occasions. The State and Local Law Enforcements discipline, accountability, and due process legislation was referred to as this. Title I of the 1968 Ominous Crime Control Act has been updated by this. This established the rules for the exact purpose of carrying out investigations within police agencies and the legal protections that officers had. Departments have revised their rules of conduct and embraced the Bill of Rights over the years. The Colorado Police Chiefs Association is one illustration of this. In 1990, this association updated its policies to reflect the proper conduct of internal investigations and the manner in which officers should be questioned (Schmidt, 2005). Additionally, many other police agencies have implemented the same internal policies to give their officers access to due process rights. Alternative Solution All officers should get policy and procedure training as an alternative to the POBR. This should also cover their legal rights under the police
