Tonya is a staff accountant for a local CPA firm. For the past 10 years, the firm has given employees a year-end bonus equal to two weeks' salary. On November 15, the firm's management team announced that there would be no annual bonus this year. Because of the firm's long history of giving a year-end bonus, Tonya and her co-workers had come to expect the bonus and felt that the CPA firm owed the money to the employees. Tonya decided that she would make up for the lost bonus by working an extra six hours of overtime per week for the rest of the year because overtime hours are paid at "time and a half" rates.
Tonya's supervisor was surprised to see overtime being reported, because there's usually not an increase in client service at the end of the calendar year. However, the overtime was not questioned, because employees are on the "honor system" in reporting their work hours.

Cutler worked as a bartender for Bowen until they orally agreed that Bowen would have the authority and responsibility for the entire active management and operation of the tavern business known as the Havana Club. Each was to receive $300 per week plus half of the net profits. The business continued under this arrangement for four years until the building was taken over by the Salt Lake City Redevelopment Agency. The agency paid $30,000 to Bowen as compensation for disruption. The business, however, was terminated after Bowen and Cutler failed to find a new suitable location. Cutler, alleging a partnership with Bowen, then brought this action against him to recover one-half of the $30,000. Bowen contends that he is entitled to the entire $30,000 because he was the sole owner of the business and that Cutler was merely his employee. Cutler argues that although Bowen owned the physical assets of the business, she, as a partner in the business, is entitled to one-half of the compensation…

- Louise has worked for Rocky for 8 years. Unfortunately, due to COVID-19 pandemic, Rocky is forced to make many employees’ redundant and Louise has been selected as part of the redundancy program. Louise is made redundant in the 2021 financial year and receives a payment of $200,000 on top of annual and long service leave entitlements totalling $8,000. Had she not been made redundant and resigned voluntarily, she would have been paid $20,000 under the relevant workplace policies (on top of any annual and long service leave entitlements). Louise will also forego bonus commission she was expected to earn in 2022 financial year. Finally, Louise borrowed money totalling $5,000 totalling $5,000 from Rocky for her latest holiday but Rocky agreed to waive this. It had been the policy of the firm to provide a holiday bonus equal to two weeks’ salary to all employees. The firm’s new management team announced on November 15 that a bonus equal to only one week’s salary would be made available to employees this year. Tonya thought that this policy was unfair because she and her coworkers planned on the full two-week bonus. The two-week bonus had been given for 10 straight years, so it seemed as though the firm had breached an implied commitment. Thus, Tonya decided that she would make up the lost bonus week by working an extra six hours of overtime per week over the next five weeks until the end of the year. Kennedy and Kennedy’s policy is to pay overtime at 150% of straight time.Tonya’s supervisor was surprised to see overtime being reported, because there is generally very little additional or unusual client service demands at…arrow_forwardTonya Latirno is a staff accountant for Cannally and Kennedy, a local CPA firm.
