Testate:

Testate is a situation where a person passed away with a valid will for the settlement and distribution of his/her estate and named the personal representative for conducting those activities.

Intestate:

When a decedent dies without any valid will then this situation is called intestacy. In this case state takes the control of decedent’s estate and settlement and distribution are made according to the intestacy laws and the court appoints a person to act as an administrator.
