Dear Attorney Max Justice,
In this case, we would have to file in state court, because tort cases are heard in state courts. In order to file in state courts, the incident had to happen within the state’s jurisdiction. Federal courts resolve disputes between states, they do not have jurisdiction over this case. It is possible to have multiple defendants we could sue in this case, which would be the bus driver, Bess Driver, and the renter, Ron Renter, since they were cited for reckless driving. The cause of action in this case would be to file a negligence lawsuit to sue them. To prove the elements of the case, for duty both the bus driver and the renter owe a legal duty to the plaintiff, the bus driver had a duty to ensure the safety of the passengers on the bus and the renter had the duty to operate the rented vehicle accordingly to prevent harming others. For causation, the actions of both defendants caused the plaintiff to be injured. For damages, due to the accident the
plaintiff, Ms. Rider, received a concussion, sprained her wrist, and sustained other injuries. I am looking forward to working with you.
